Terms of Service

Agreement to terms

By accessing or using 1DB ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

Description of service

1DB is a lead capture and data management platform that provides form data collection, CRM synchronization, and AI-powered data querying. The Service is provided as a cloud-hosted platform accessible via web browser and API.

Account registration

To use the Service, you must create an account with accurate and complete information. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

Acceptable use

You agree not to:

• Use the Service for any illegal purpose
• Submit or store data that infringes on third-party rights
• Attempt to gain unauthorized access to the Service or its systems
• Use the Service to send unsolicited communications (spam)
• Interfere with or disrupt the Service's infrastructure
• Exceed rate limits or abuse API access

Data ownership

You retain all rights to the data you submit to the Service. 1DB claims no ownership over your lead data. We process your data solely to provide the Service.

Payment terms

Paid plans are billed monthly or annually in advance. Prices are in USD unless otherwise stated. We may change pricing with 30 days' notice. Refunds are available within 14 days of initial purchase.

Service availability

We target 99.9% uptime for all plans and 99.99% for Enterprise plans. Planned maintenance windows are communicated in advance. We are not liable for downtime caused by factors outside our control.

Intellectual property

The Service, including its design, code, and documentation, is owned by 1DB and protected by intellectual property laws. Your use of the Service does not grant you any ownership rights.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 1DB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify and hold harmless 1DB from any claims arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

Termination

Either party may terminate this agreement at any time. Upon termination, your right to use the Service ceases. We will retain your data for 30 days after termination, after which it will be permanently deleted.

Changes to terms

We may modify these Terms at any time. Material changes will be communicated via email at least 30 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance.

Governing law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law provisions.
